Как стало известно “Ъ”, Симоновский райсуд Москвы приговорил к одному году и девяти месяцам колонии одного из бывших топ-менеджеров российской «дочки» международной брокерской компании TeleTrade Александра Калашникова. Его признали виновным в нанесении ущерба в размере более 100 млн руб. двум с половиной десяткам потерпевших от действий форекс-дилера. Дело в отношении одного из организаторов — скончавшегося еще в 2019 году в Германии Владимира Чернобая — было прекращено по нереабилитирующим основаниям. А на прошлой неделе в Чехии задержали его племянника Олега Суворова, курировавшего в компании финансовый блок. Сейчас решается вопрос о его экстрадиции.

Уголовное дело в отношении Александра Калашникова, обвинявшегося в особо крупном мошенничестве (ч. 4 ст. 159 УК РФ), Симоновский райсуд столицы начал рассматривать в августе прошлого года. Учитывая, что подсудимый, курировавший в ООО «Телетрейд групп» столичный и более 50 региональных офисов форекс-дилера, полностью признал свою вину и заключил досудебное соглашение о сотрудничестве с прокурором, процесс не должен был занять много времени. Однако уже через пару заседаний суду пришлось перейти к обычному формату слушания этого дела с истребованием всех доказательств, допросом свидетелей и потерпевших. Причиной, по данным “Ъ”, стала неожиданно изменившаяся позиция обвиняемого, якобы отказавшегося от некоторых ранее данных показаний.

В итоге в ходе прений гособвинитель затребовал для Александра Калашникова четыре с половиной года колонии общего режима со штрафом 850 тыс. руб. Однако судья Дмитрий Мерзляков позицию прокурора не разделил и, признав подсудимого виновным в хищении более 100 млн руб. у двух с половиной десятков потерпевших, назначил ему наказание в виде одного года и девяти месяцев колонии общего режима. Причем почти весь этот срок господин Калашников уже отбыл под стражей и домашним арестом во время следствия.

Столь небольшой срок, по некоторым данным, объясняется тем, что при вынесении приговора суд все же принял во внимание досудебное соглашение с обвиняемым, в частности было учтено признание им своей вины.

Напомним, что следственный департамент МВД разбирался в этой истории шесть лет. Как следует из материалов уголовного дела, мошенники, прикрываясь брендом TeleTrade, который еще в 2016 году получил лицензию Центробанка на брокерскую деятельность, подыскивали клиентов путем банального обзвона по так называемым холодным базам (список абонентов МГТС, базы ГИБДД и пр.). В течение нескольких лет злоумышленники привлекали средства граждан под предлогом участия в игре на рынке форекс, а затем выводили их из-под контроля клиентов и похищали. В 2016 году сотрудники ГУЭБиПК МВД провели обыски в 11 столичных офисах, откуда осуществлялось руководство всеми 124 региональными подразделениями ООО «Телетрейд групп» (лицензия на брокерскую деятельность на рынке ценных бумаг была отозвана в январе 2019 года).

Предполагаемого организатора мошенничества — владельца российской «дочки» международной брокерской компании TeleTrade Владимира Чернобая — задерживать тогда не стали, к следователю его вызвали повесткой, но на допрос он так и не явился. А через несколько дней он и его племянник Олег Суворов, курировавший в компании финансовый блок, уехали за границу. 30 октября 2018 года обоих объявили в международный розыск. Господин Чернобай прошел в Германии курс лечения от рака, но 18 июня 2019 года все же скончался. Его дело с согласия родственников прекратили по нереабилитирующим основаниям. Его племянника, по данным “Ъ”, на прошлой неделе задержали в Чехии. Генпрокуратура уже направила в эту страну запрос об экстрадиции Олега Суворова. В материалах его дела речь идет о причинении ущерба на сумму якобы свыше 1 млрд руб.

Между тем фигурантами расследования все это время являлись задержанные осенью 2018 года вместе с Александром Калашниковым Владимир Лапшов, отвечавший в компании за безопасность и урегулирование проблем с клиентами, а также специалист по набору кадров Андрей Котов.

Все трое формально никакого отношения к ООО не имели, однако именно эти люди, как установило следствие, являлись неофициальными руководителями организации.

После того как прокуратура удовлетворила ходатайство обвиняемого Калашникова о досудебном соглашении, его дело выделили в отдельное производство.

Отметим, что процесс в отношении Владимира Лапшова и Андрея Котова начался практически одновременно с рассмотрением дела в отношении Александра Калашникова, но в Коптевском райсуде Москвы. Сейчас слушание этого дела также близится к завершению.
